| Middle Tennessee: I need a lawyer who is willing to sue a district attorney. Who is up to this? A DA in my home county is incompetent, lazy, and misguided. I want to sue him personally and/or the state if possible for his failure to follow the rules of the Victims Bill of Rights and possibly the rules on Criminal Procedure. He and his office made mistakes, did not follow procedure, and has failed/refused to follow up on other items--some of which are felonies where he should not have this discretion. Who is up for this job? Where can I look or find such a person for this job? Here in California (where I practice) D.A's enjoy immunity from suit and cannot be personally sued for incompetence. I would be willing to bet that TN has the exact same laws. The government does not want their D.A.'s sued. If you think the D.A. is falling down on the job then start a public campaign to have him removed. Talk to the press. Start a petition. Report him/her to the Bar. But suing him personally? Ain't gonna happen. All Answers Answer 1 Look for a victim's advocacy group in your state. The Bar Association may be able to help you find representation, probably a federal civil rights case or an ethics committee concern by your description. Your case should probably be aimed at the his employer (County ?), he will be named as well but ultimate responsibility lies with the government entity that employs him.
