How can I sue someone if I can't afford a lawyer?
I was rear-ended at high speed by an uninsured motorist driving a late-model Cadillac; conventional wisdom is that it's pointless to sue someone who can't afford insurance, but given that he was driving a luxury car I suspect the guy has the resources to pay for destroying my '94 Del Sol which I value at around $3000.

take him to small claims. there it is just the two of you. no lawyer needed. However! If you are sueing for injuries, that's another story. ************************* Mojado, I'm no expert. But, I'm pretty sure they only provide a lawyer if you're being charge w/ a CRIME. He's not. Thus, not so much. Thanks though.

maybe he stole that car. But you can sue anyone, a lawyer can be provided for you if you can't afford one

You don't need a lawyer for that. Depending on which state you live in you can sue for up to $5000 in small claims court. Just go to the small claims court in your area and file a claim. You will however need to get actual estimates of damage and now just what you value it at

Look for a lawyer anyway. These cases are usually taken on a "contingency" basis, meaning you don't pay the lawyer's fee unless you win and then you pay a percentage to the lawyer. You will have to pay for costs of the lawsuit, even if you lose. You would have to do this anyway if sued without a lawyer. But--if your total damages are $3,000 and you have no personal injury, you can take your case to small claims without a lawyer. Just head on down to the courthouse and get some forms. But remember, you can only sue once. If you sue in small claims, you can't sue again to claim whiplash or other damages.

Why aren't you letting your insurance company handle this? Isn't uninsuranced motorist coverage required? I got hit by an uninsured motorist, I had a three hundred dollar deductible which I evenually got 1-1/2 year later when the my insurance company sued or settled with the other driver.

A Lawyer has an ethical duty, imposed by law, to assess reasonable fees for services. Failure to observe the duty can subject the lawyer to suspension or disbarment.
